Governor Cuomo released Executive Order 202.13 (hereinafter “Executive Order”),  which postpones “until at least June 1, 2020” all school district elections scheduled to take place in April or May, including the annual budget votes and school board elections, originally scheduled for May 19, 2020.1  It also similarly postpones any library board or village elections scheduled to take place in April or May.  The Executive Order further states that all such elections “are subject to further directive as to the timing, location or manner of voting for such elections.”  

In addition, the Executive Order postpones the “circulation, filing and collection” of any nominating petitions for any office that would otherwise be circulated or filed pursuant to the Education Law or Election Law, i.e. nominating petitions for school board candidates.  The Executive Order does not address when and what process will be directed following the postponement.
